Consumable Payment Agreement

PicScribe offers paid services, including a weekly subscription and an annual subscription. By subscribing to our service, users can access premium features, allowing them to dynamically add text to images. The text will appear along the user’s manually drawn path on the image. Our subscription service includes a 3-day free trial, and users can cancel their subscription at least 24 hours in advance.

Automatic Renewal Service Agreement

To protect the rights of users (hereinafter referred to as "you"), please read this service agreement (hereinafter referred to as "this agreement") in detail before using this service, especially the bold parts. Unless you have read and agreed to all the contents of this agreement, you are not entitled to use this service. If you purchase or use this service, it means that you have reached an agreement with the company and voluntarily accept all the contents of this agreement. If you are under 18 years old, please use this service accompanied by a legal guardian or after obtaining the consent of a legal guardian; minors exercising and performing the rights and obligations under this agreement are deemed to have obtained the recognition of the legal guardian, and this agreement is legally binding on you and your legal guardian.

Article 1: Acceptance and Amendment of the Service Agreement

• 1.1 The contents of this agreement include the text of the agreement, the "User Service Agreement," and various rules that the company has published or may publish/update in the future. All rules are an inseparable part of this agreement and have the same legal effect as the text of the agreement. If there is a conflict between the text of this agreement and the aforementioned rules, the text of this agreement shall prevail. Unless expressly stated otherwise, your use of the automatic renewal service is subject to this agreement.
• 1.2 Due to the characteristics of the internet industry, this agreement and related service rules may need to be revised due to business development needs. The company will announce the revisions on the platform. You can review the latest agreement terms. After the company modifies the terms, if you do not accept the revised terms, you can choose to terminate the use of the automatic renewal service. If you continue to use this service, it will be deemed that you have accepted the revised agreement.

Article 2: Service Description

• 2.1 This service is provided to prevent service interruption due to untimely renewal based on your need for automatic renewal after you subscribe to VIP membership or other paid services. The automatic renewal includes multiple subscription service periods, and fees are calculated according to the actual corresponding billing cycle.
• 2.2 If you open this service through Apple Inc. (hereinafter referred to as "Apple") Apple ID, and do not actively cancel this automatic renewal service 24 hours before the next subscription service expires, Apple will automatically deduct the next subscription service fee from the Apple ID account (hereinafter collectively referred to as "account") balance 24 hours before each subscription period expires, thereby extending the service validity period corresponding to the subscription period.
• 2.3 If you open this service through Android products and do not actively cancel this automatic renewal service during the subscription service period, third-party payment channels will automatically deduct the next subscription service fee from the third-party payment account (including but not limited to Alipay account, WeChat wallet account) and other accounts (hereinafter collectively referred to as "account") bound when you open this automatic renewal service one day before the paid service expires, thereby extending the paid service validity period corresponding to the subscription period.
• 2.4 You understand and agree that, due to some channels being decided by the operator or payment channel based on actual situations, the deduction time of the aforementioned automatic renewal service is subject to the actual deduction time of each channel.
• 2.5 Please pay attention to the status of the aforementioned accounts and the available balance. If the renewal fails due to account issues or insufficient balance, you will bear the risks or losses caused (such as the termination of corresponding rights, inability to participate in activities, impact on membership status, etc.). If you do not actively choose to cancel this service, it will be deemed that you agree to the company's occasional deduction attempts within a certain period after the subscription service expires (specifically according to the deduction rules of each payment channel). The company will continue to provide you with automatic renewal services when your account balance is sufficient. Once the deduction is successful, the company will continue to provide you with paid rights.

Article 3: Automatic Renewal Usage Rules

• 3.1 Please pay special attention that based on the characteristics of the automatic renewal service, automatic deductions will be completed according to the methods and times agreed in Articles 2.2, 2.3, and 2.4 of this agreement. If you do not explicitly cancel the automatic renewal service before the deduction, the company will issue the deduction instruction for the next subscription period to the relevant subject according to your commission, and in principle, the fees deducted based on this instruction will not be refunded.
• 3.2 If an error occurs during the deduction process, the company and you should cooperate closely to find out the cause and each bear the loss caused by their own fault; if the loss is caused by the unequal faults of both parties, both parties shall bear the corresponding responsibility according to the degree of fault; if both parties are responsible, both parties shall share the responsibility.
• 3.3 The company does not charge any additional fees for you to open the automatic renewal service, but the company has the right to decide whether to charge additional fees for the automatic renewal service based on business development needs and announce it on the relevant page.
• 3.4 The service provided by the company to you is only limited to use on this platform. Any use of paid services by malicious cracking or other illegal means to bypass renewal constitutes a violation of this agreement. All legal consequences arising therefrom shall be borne by the perpetrator, and the company will pursue the perpetrator's legal responsibility according to the law.

Article 4: Service Suspension, Interruption, and Termination

• 4.1 Unless otherwise notified or announced by the company, this service will be effective for a long time. This agreement will take effect after you choose to accept or use this service, until you terminate this service or cancel the paid service qualification.
• 4.2 In any of the following situations, the company has the right to immediately terminate the service to you without any liability to you or any third party:(1) Your illegal or infringing behavior is confirmed by a legally effective legal document of the national administrative or judicial authority, or the company, based on its own judgment, believes that your behavior is suspected of violating the content of this agreement or the usage rules published by the platform from time to time, or suspected of violating laws and regulations; (2) Your behavior interferes with the normal operation of any part or function of the platform; (3) The company believes that there is a major risk in providing you with this service.
• 4.3 The company may choose to suspend or interrupt this service based on its business decisions and other reasons. If such situations occur, the company will notify you in the form of an announcement.
• 4.4 If you wish to cancel the automatic renewal, you can cancel the automatic renewal 24 hours before the next subscription period ends through Apple iOS "App Store" account settings/Android app internal management/third-party payment client.
• 4.5 After the service is successfully canceled, it does not affect the paid services that have been successfully deducted and become effective. After the effective paid service period expires, it will no longer be automatically renewed. The deduction instructions you have commissioned the company for automatic renewal before choosing to terminate this service are still valid, and the fees deducted based on this instruction will not be refunded, and you shall bear the relevant responsibility yourself.

Article 5: Miscellaneous

• 5.1 Law and Dispute Resolution: This agreement is governed by the laws of the People's Republic of China, excluding all conflict of law provisions. In case of any disputes, you and the company agree to submit the disputes to the court with jurisdiction where the company is located.
• 5.2 The company's failure to exercise, or timely exercise, or fully exercise any rights under this agreement or in accordance with legal provisions shall not be deemed as a waiver of such rights, nor shall it affect the company's exercise of such rights in the future.
